Terms & Conditions

Last updated: 1 October 2026

These terms govern your use of this website and, together with the proposal signed for your project, the services Pixiophile Solutions provides.

1. About these terms

This website is operated by PIXIOPHILE SOLUTIONS PRIVATE LIMITED (“Pixiophile Solutions”, “we”, “us”, “our”), with its registered office at:

A-1, Sundarvan Society, Near Prathna Vidhyalay, Kubernagar, Ahmadabad City, Ahmedabad - 382340, Gujarat, India

By using this website or engaging us for services, you accept these terms. If you do not accept them, please do not use the site.

2. Services

We provide design, web and mobile development, custom software, e-commerce, SEO and digital marketing services. The precise scope, deliverables and timeline for any engagement are set out in the written proposal, quotation or statement of work agreed for that project (the “Proposal”).

Content on this website, including service descriptions and case studies, is provided for general information. It is not an offer and does not form part of any contract between us.

3. Fees, payment and cancellation

Fees, payment schedule, refunds and cancellation terms are governed by the Proposal agreed for your project. Where the Proposal and these terms differ on a commercial matter, the Proposal prevails. In addition:

  • Quotations are valid for 30 days from the date of issue unless stated otherwise.
  • Unless the Proposal says otherwise, fees are exclusive of applicable taxes, and of third-party costs such as domains, hosting, licences, plugins, stock assets and ad spend.
  • We may suspend work and withhold delivery on overdue invoices after giving written notice.

4. Your responsibilities

You agree to:

  • Provide the content, assets, access and approvals we need, in reasonable time, so that work can proceed.
  • Ensure that any material you supply is accurate and that you own it or are licensed to use it.
  • Nominate a point of contact authorised to give feedback and sign off deliverables.
  • Keep credentials we share with you secure and confidential.

Delays in providing content, feedback or approvals will move project timelines accordingly.

5. Intellectual property

On receipt of all amounts due for a project, ownership of the custom deliverables created specifically for you under that project transfers to you.

We retain ownership of everything that pre-exists the project or is reusable across clients, including our frameworks, libraries, components, templates, internal tooling, development methods and know-how. Where any of this is embedded in your deliverables, we grant you a perpetual, non-exclusive, worldwide licence to use it as part of those deliverables.

Deliverables may incorporate third-party software, fonts, plugins or stock assets that remain subject to their own licences, which pass to you on their own terms.

We may display completed work, screenshots and non-confidential project outcomes in our portfolio, case studies and marketing material. If you would prefer we did not, tell us in writing and we will remove it.

All content on this website, including text, graphics, logos and code, belongs to us or our licensors and may not be copied or reused without our written permission.

6. Timelines

Timelines in a Proposal are good-faith estimates based on the agreed scope and on receiving what we need from you on time. They are not guaranteed dates. Changes to scope after work begins may affect both the timeline and the fees, and will be agreed in writing before we proceed.

7. Confidentiality

Each of us may receive information from the other that is marked confidential or would reasonably be understood to be confidential. Neither of us will disclose that information to anyone else, except to team members and contractors who need it to deliver the project, or where disclosure is required by law. This obligation continues after the engagement ends.

8. Warranties and disclaimers

We will perform our services with reasonable skill and care and in a professional manner. Beyond that, this website and its content are provided “as is”, without warranties of any kind to the extent permitted by law.

We do not warrant that the website will be uninterrupted or error-free, and we do not guarantee specific business outcomes such as search engine rankings, traffic volumes, conversion rates or advertising returns. These depend on factors outside our control, including third-party platform algorithms and policies.

9. Limitation of liability

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, data, business or goodwill.

Our total aggregate liability arising out of or in connection with an engagement is limited to the total fees paid by you to us for that engagement. Nothing in these terms limits liability that cannot be limited under applicable law.

10. Indemnity

You agree to indemnify us against claims, damages and reasonable costs arising from material you supply to us, or from your use of the deliverables in breach of these terms or of applicable law.

11. Termination

Either party may terminate an engagement by written notice if the other materially breaches these terms or the Proposal and does not remedy the breach within a reasonable period after being notified. On termination, amounts due for work performed up to the termination date remain payable, and the consequences set out in the Proposal apply.

12. Third-party services

Projects often rely on third-party platforms and services such as hosting providers, payment gateways, advertising platforms and plugins. These operate under their own terms, pricing and availability, and we are not responsible for their acts, omissions or changes in policy.

13. Privacy

Our handling of personal data is described in our Privacy Policy, which forms part of these terms.

14. Changes to these terms

We may update these terms from time to time. The “last updated” date at the top of this page reflects the current version. Changes do not affect a Proposal already signed, unless we agree otherwise in writing.

15. Governing law and jurisdiction

These terms are governed by the laws of India. The courts at Ahmedabad, Gujarat have exclusive jurisdiction over any dispute arising out of or in connection with them.
